The Case against Elena Kagan

1.) As a White House adviser, Supreme Court nominee Elena Kagan indicated support for affirmative action as good law and good politics. Kagan supports public abortion funding.
2.) A newly produced document from the Clinton archives is the second to show Elena Kagan defending ex-president Bill Clinton’s veto of a bill to ban partial-birth abortions.
3.) 31 senators voted against Kagan’s confirmation as solicitor general about a year ago, finding her too inexperienced for even that less important job. { Phyllis Schlafly}
4.) In Kagan’s prior hearing before the Judiciary Committee, she declared her support for using foreign law to interpret U.S. Constitution. {THIS ALONE SHOULD DISQUALIFY HER. GHK}
5.) A Gallup poll released 3 weeks ago showed that 42% of Americans want a new Supreme Court justice who will move the court in the conservative direction, while only 27% want a new justice who will make it more liberal. {We are a pro-life center right nation. GHK}
6.) Kagan excluded military recruiters from Harvard Law School, where she was appointed dean despite having published almost nothing scholarly. Kagan even joined a brief submitted to the Supreme Court that attempted to obtain a constitutional right for schools to exclude military recruiters. In Rumsfeld v. 7.) During the Clinton administration Kagan was intimately involved in anti-gun initiatives pushed by Clinton. In 1997, Kagan drafted an executive order banning the importation of certain “dangerous” semi-automatic assault rifles. A year later Clinton banned over 58 types of firearms and accessories. 8.) There is abundant evidence that on the Supreme Court Kagan would legalize same-sex marriage and overturn “Don’t Ask, Don’t Tell Rule” against open homosexuals in the military.
9.) Kagan’s Princeton thesis outlines the New York socialist movement at the beginning of the 20th century. Kagan wrote, “Americans are more likely to speak of a golden past than of a golden future, of capitalism’s glories than of socialism’[s greatness. Conformity overrides dissent, the desire to conserve has overwhelmed the urge to alter. 11.) Kagan has no experience as a judge. She has spent most of her career in academia and government. She reminds us of President Obama with no leadership experience.
